Digitální platformy a BOZP

Tato příručka se zaměřuje zejména na vztah platformové práce a zajištění bezpečnosti a ochrany zdraví při práci, popisuje psychosociální zátěž pracovníků a specifická rizika, která jsou s platformovou prací spojena, a to zejména s ohledem na algoritmický způsob řízení práce. Při zpracování autorky vycházely zejména z odborné literatury, dostupných studií a průzkumů na toto téma, právních předpisů, soudních rozhodnutí a koncepčních materiálů evropských a mezinárodních institucí. Na závěr jsou uvedeny jako příklady správné praxe možné preventivní přístupy k řešení problematiky platformové práce, a to ze strany digitálních platforem, státních orgánů a institucí v podobě legislativních a nelegislativních opatření, i samotných platformových pracovníků a jejich zástupců.

8 digitální fyzický Abstract: The thesis offers a phenomenological view of the contemporary hybrid world, consisting of interpenetrating two inseparable spheres: the physical (originally material) world and the digital (virtual world). My work shows how we can think about the world by separating the physical and the digital. In my research, I involved students in the eighth year of high school, aged 12-14, who are referred to as Generation Z or "digital natives". I was interested in how students described these two worlds and how they related to them and their intersection. I first explored the phenomenon of the digital world as part of my own artistic research, looking for themes and aspects to highlight. As part of my early research, I subjected the artistic mind maps to qualitative analysis, but the maps did not lead me to a deeper understanding of the digital-virtual world in the way I would expected. What did emerge, however, was the shape of the students' instru- mental relationship to the digital world through physical space and their own physical bodies. I was also interested in how students used the Internet and social networks, so I wanted to have different view on something that I don't usually learn in the classroom as a teacher. Performance of dependent work through digital platforms

PERFORMANCE OF DEPENDENT WORK THROUGH DIGITAL PLATFORMS ABSTRACT This thesis discusses the issue of work performance through digital platforms, especially regarding whether it is possible to classify such activity as "dependent work", particularly with regard to the laws of the Czech Republic. The thesis responds to the current legal "vacuum" surrounding the performance of work through digital platforms and the legal status of persons who perform such activity (referred to in the thesis as workers). The mentioned legal "vacuum" stems primarily from the absence of sufficient legal regulation in the given area and the "unconventionality" of such a way of performing work. Digital platforms describe their workers as independent entrepreneurs, and this practice is quietly tolerated by the Czech Republic (e. g. administrative authorities). However, there can be more than reasonable doubts about the veracity of such proclamation. Therefore, the thesis firstly analyzes the characteristics and conditions of dependent work according to the laws of the Czech Republic, which are then applied to the reality of the performance of work through digital platforms. This bachelor's thesis is devoted to the impact of the COVID-19 pandemic on dance lecturers as representatives of the creative economy. The aim of the work was to reveal what strategies and practices were used by dance instructors to move dance lessons to an online environment under the conditions of limiting personal contacts as part of anti-coronavirus measures. Attention was also paid to the positive and negative factors that influenced the transition and adaptation of dance instructors in the online environment. The research draws on the concepts of the creative class and the creative economy as sources of economic progress in the time of the COVID-19 pandemic. The work is based on qualitative research, using the methods of semi-structured interviews with dance instructors and hidden participant observation of dance lessons. 8 dance trainers aged 21-35 participated in the research. Distance learning and the use of digital technologies in education

This thesis focuses on the effect of the covid-19 pandemic on education at a selected primary school from the point of view of teachers during the first and second wave. It focuses on defining the concepts such as distance learning, e-learning, digital technologies and platforms. The work reflects how the Czech education system was affected from March 2020 to May 2021. The theoretical part focuses on the theoretical conception of terms that are associated with the pandemic and distance learning, but also with the concept of socialization and communication, which were greatly affected during the pandemic, especially when it comes to children. The research part was then carried out with the help of a semi-structured interview, which was conducted at a selected primary school in groups with four teachers. One of the most fundamental questions of the whole interview was the greatness of the pandemic`s effect on the pupils and the teachers of this particular primary school. Digital platforms and its impact on labor law

This thesis provides an analysis of digital platforms and its impact on labour law and related work patterns in general. The main focus is upon description of caused problems and their possible solutions whereas the question of worker's status in the platform economy and its arrangements is predominantly discussed. The introduction leads the reader to general description of digital platforms and its three main subsets (crowdsourcing, on deman work and passenger transport services). For a better undestanding the thesis further gives an idea of working conditions by analysing each working stage affected by platforms. After these initial introductory findings the thesis focuses on potential problems. The possible problems are first being described in general and then discussed from the practical point of view as they were already seen by various courts in the past. The sole analysis of courts decision is rather extensive since the three chosen decisions not only give us answers to some problematic questions but they also provide highly beneficial info about platforms in general and their business models as well. The Position of political parties to the Shared economy: Case study of the city of Prague

The following bachelor thesis focuses on the issue of sharing economy and the position of czech political parties towards it. At the beginning of the thesis the author analyzes the definition of a sharing economy, its various types and problems associated with it. At the same time she also presents the positives that a sharing economy offers. The focus is put on three most common types of sharing economy - shared accommodation (through the Airbnb platform), shared ride (through the Uber platform) and carsharing. The thesis describes the current legislative framework of each sector in the Czech Republic and also mentions examples of foreign legislation. The main aim is to outline the likely future steps of the Prague City Council in the regulation of shared economy. The author also compares opinions amongst and within the political parties during the last two election periods. The result of this bachelor thesis is a systematic view of the issue of shared economy in Prague in both election periods, and an outline of the likely development in the coming years. Selected Aspects of Sharing Economy with emphasis on Airbnb and Uber

Selected aspects of sharing economy with emphasis on Airbnb and Uber Abstract This paper focuses on the legal regulation of digital platforms which are used to arrange short-term accommodation (the most popular representative is Airbnb) and passenger transport (where Uber is the best-known platform). In the introduction the author explains why he considers it inappropriate to say these platforms are part of "sharing economy", although this term is currently widely used. In addition, the author examines the benefits of Airbnb and Uber platforms in general, such as user comfort, a rating system that allows quality control of provided services, lower prices for the customer than with traditional service providers and a simple way to earn some extra money. At the same time, the author mentions negative aspects of these platforms, such as lower collection of taxes and fees, poor protection of employees and potentially also customers, or reduction of availability and quality of housing. In the next part of the paper the author focuses on each of the mentioned platforms and evaluates the regulation of these platforms, or rather service providers that use these platforms, in the light of both Czech and European case law.
